WASHINGTON — As a part of the public comment period for the U.S. Department of Education’s proposed rule that would negatively affect the future of women’s sports, U.S. Senator Tommy Tuberville (R-AL) today submitted a public comment urging the department to abandon its efforts to change how Title IX is implemented.
Announced in July, the Biden administration’s proposed rule would, among other things, expand the definition of “sex” to include “gender identity,” forcing institutions that accept federal funds to allow biological males to compete in women’s sports. If implemented, the change would come just months after Senator Tuberville joined millions of Americans in celebrating the 50-year anniversary of the revolutionary Title IX law, which has given generations of women the opportunity to meaningfully participate at the highest levels of competition.
“Congress made clear its intention to establish Title IX as a prohibition on discrimination against women at institutions that received Federal financial assistance. By broadening the definition of “sex” based on weakly-associated case law and polarizing social concepts adopted by the progressive left, the intent of the law is destroyed, and women are marginalized yet again,” wrote Senator Tuberville.
He continued, “This proposed rule is a monumental setback for the generations of women who have benefited from Title IX’s enactment over the last fifty years. The Department should not move forward with this proposed rule, but instead, work with Congress on legislative action meant to strengthen the protections afforded women in the original statute.”

The public comment follows months of work from Senator Tuberville to sound the alarm about the growing threats to female athletes’ level playing field and the future of women’s sports posed by the Biden administration’s policies.
Senator Tuberville, who began his career as a high school girls’ basketball coach, is leading the efforts in the U.S. Senate to protect women’s sports. The Senator has been vocal about the Biden administration’s proposed rule changes to how Title IX is implemented, particularly how the changes would affect women’s sports.
In July, Senator Tuberville joined 20 of his colleagues in strongly criticizing the U.S. Department of Education’s proposed rule and urging the Secretary of Education to extend the public comment period. Earlier this year, he called for the vote of the Protection of Women and Girls in Sports Act, which Democrats blocked from consideration.
