Tuberville Introduces Legislation to Ban Sharia Law in the United States

WASHINGTON – Today, U.S. Senator Tommy Tuberville (R-AL) introduced two pieces of legislation to ban Sharia Law in the United States. Last week, Sen. Tuberville delivered a fiery floor speech about how radical Islamic extremism poses a tremendous national security risk to the United States.

Sen. Tuberville is introducing the No Sharia Act, which would prohibit the application of Sharia Law in the U.S. where it would violate constitutional rights, and the Preserving a Sharia Free America Act, which would prevent all foreign nationals advocating for Sharia Law from entering the U.S.

“Sharia Law is fundamentally anti-American and has no place in our country,” said Sen. Tuberville.“If you want to peacefully practice your religion, you have every right to do so under the Constitution. But if you want to come to the United States and advocate for the practice of Sharia Law over U.S. law, you should not be here. We do not want people who chant ‘death to America’ residing in our communities and endangering our families. We must protect American values, not apologize for them. I hope my colleagues can come alongside me in this effort to preserve our Constitutional and God-given rights.”

Rep. Randy Fine (R-FL-06) and Rep. Keith Self (R-TX-03) introduced the No Sharia Act and Rep. Chip Roy (R-TX-21) introduced the Preserving a Sharia Free America Act in the U.S. House of Representatives.

BACKGROUND:

Specifically, the No Sharia Act would:

  • Prohibit courts from enforcing judgments, decrees, or contracts relying on foreign laws that violate the Constitution.
  • Invalidate contract provisions based on foreign laws if they violate Constitutional rights.
  • Bar application of marriage, divorce, custody, adoption, or inheritance if inconsistent with U.S. law.

Specifically, the Preserving a Sharia Free America Act would: 

  • Deny or revoke any immigration benefit, visa, immigration relief, or admission to the U.S. to any alien who advocates for Sharia Law in a way that is incompatible with the Constitution.
  • Prevent activist courts and judges from upending a final decision from agencies that find Sharia Law adherents removable from the U.S.
  • Ensure that any alien who presents false statements about his or her advocacy of Sharia Law, which would violate a person’s rights under the Constitution, to any federal agency, would have his or her immigration benefits, immigration relief, or visa revoked.
